General Terms and Conditions of Sale — AmpliDestock
1. Seller and Scope of Application
AmpliDestock is a brand operated by AMPLIFEO, a limited liability company with a capital of 3 000 €, registered with the Strasbourg Trade and Companies Register under number 921 501 771, whose registered office is located at 32 allée de la Robertsau, 67000 Strasbourg, France. Intra-community VAT number: FR87921501771. Contact: contact@amplidestock.com.
These conditions govern distance selling on amplidestock.com of equipment, furniture, devices, accessories, consumables, and other products offered in the catalog. They apply to consumers and professional customers. Provisions reserved for professionals do not apply to consumers or persons benefiting from special legal protection.
The applicable version is the one communicated and accepted at the time of the order. Any subsequent modification does not affect orders already concluded. The customer may keep these conditions; the applicable version is communicated to them on a durable medium with the confirmation of their order.
2. Product Information and Equipment Choice
Before ordering, the customer consults the product sheet: characteristics, dimensions, weight, capacity, power supply, included accessories, installation conditions, restrictions, and intended use. Situational presentations may show accessories sold separately; the delivered content is specified on the sheet. The announced characteristics bind the seller.
The professional customer ensures the compatibility of the equipment with their premises, installations, qualifications, and intended use. In case of doubt, they contact AmpliDestock before purchase. This verification does not exempt the seller from their obligations of information, advice, and compliance. No product is presented as medical, sterilizer, or suitable for regulated use without express indication and supporting documents corresponding to that use.
3. Availability, Order, and Confirmation
The customer builds their cart, verifies references, quantities, and contact details, chooses delivery and payment, then reviews the total price and the GTC. They can correct errors before final validation, which clearly indicates the obligation to pay. The order is confirmed by email.
Availability information is that displayed at the time of order. If unavailability is discovered afterward, the customer is promptly informed. No replacement product, credit note, or additional delay is imposed on them. Agreed solutions and, if applicable, cancellation and refund are confirmed in writing respecting their rights.
A request may be refused for a legitimate reason, notably established fraud or non-payment. A manifest pricing error leads to contact with the customer; it does not authorize charging a higher price without their agreement.
4. Prices and Fees
Prices are expressed in the currency displayed on the site. For a consumer, the total price including all taxes and applicable fees is indicated before ordering. A tax-exclusive presentation for professionals is still accompanied by necessary tax information. The VAT rate depends notably on the destination and applicable tax status.
The price accepted at the time of order is not subject to unilateral increase. Discounts and promotional codes apply according to the conditions, products, and dates announced with the offer. Conditions for combining offers are indicated before use.
For bulky transport or a destination requiring a quote, the amount must be communicated and accepted before concluding the corresponding order. No supplier tariff difference alone can justify additional fees imposed after a firm order.
For destinations outside the European Union offered for payment, formalities, customs duties, and taxes possibly due on import are specified before purchase as far as they can be determined. Their possible assumption by the customer is clearly announced.
5. Payment
Payment is made by credit card, PayPal, or bank transfer, according to the means effectively offered for the order. Unless otherwise agreed in writing, the price is payable in full before shipment. Transfer instructions and the reference to report are sent with the order. Preparation depends on the effective receipt of funds and announced availability.
Split payment is only available when expressly offered by the provider, according to their conditions and eligibility criteria. No financing or split payment is guaranteed by AmpliDestock. Refunds are made according to applicable rules, without fees imposed on the consumer for a legal refund.
6. Delivery of Parcels and Bulky Products
Served destinations, available carriers, fees, and delivery time or date are specified before validation. Products may ship from a partner warehouse and be subject to multiple shipments, without additional fees not accepted. Working days exclude weekends and public holidays applicable to transport.
Depending on the product and destination, parcels may be entrusted to GLS and pallets to DACHSER or RABEN, or to an equivalent carrier indicated for shipment. A general delay mention on the shop does not replace the contractual delay announced for the order. Delays vary for pallets, islands, remote areas, special orders, and customs formalities.
For pallet delivery, the standard service is delivery to an accessible point agreed with the carrier, without carrying to the floor, unpacking, assembly, or installation, except for expressly purchased service. The customer reports before ordering narrow accesses, stairs, circulation restrictions, or absence of suitable reception means. Additional service cannot be charged without prior information and agreement.
The customer provides an exact address and contact details allowing delivery. In case of absence or impossible access attributable to the customer, a new presentation may incur actual fees previously announced and accepted. No arbitrary flat fee applies.
7. Receipt, Damage, and Delay
It is recommended to check the condition of parcels and quantities upon receipt, to note precise reservations on the carrier's document, and to take photographs in case of anomaly. The customer promptly contacts AmpliDestock indicating their order reference. For consumers, absence of reservations or reporting within 24 or 48 hours does not remove legal rights.
For a consumer, the risk of loss or damage transfers when they physically take possession of the good, or when a third party they designate receives it. The exception provided by law for a carrier chosen by the consumer and not offered by the seller remains applicable.
In case of exceeding the agreed delay, the consumer retains the possibilities of payment suspension or contract termination provided by law, notably after a request for delivery within a reasonable additional delay when required. Refund following termination occurs within the legal delay, at the latest fourteen days after it. No additional arbitrary waiting period of fourteen days is imposed before exercising these rights.
8. Consumer Withdrawal
The consumer has fourteen days from receipt of the good to notify withdrawal without having to justify it. For an order delivered in several shipments, the starting point is determined according to applicable legal rules, notably upon receipt of the last good when these rules provide for it.
Notification may be made by email, mail, using the form below, or any clear statement. The form is not mandatory. Exercising the right does not depend on prior obtaining a return number.
The good must be returned no later than fourteen days after withdrawal notification. Contact customer service to obtain instructions and the appropriate return address for the product. Do not return the good directly to a supplier without AmpliDestock's instruction. This contact does not condition the notification of your withdrawal.
The good is protected for transport, with its accessories and documentation. The original packaging is recommended when it provides adequate protection, without being an absolute condition of the right of withdrawal. Any depreciation can only be retained for handling beyond what is necessary to establish the nature, characteristics, and proper functioning of the good, under conditions provided by law. No flat restocking fee is applied to the consumer.
The seller refunds the amounts due, including initial standard delivery fees, within fourteen days following notification. For a sale of goods, they may delay refund until recovery of the good or receipt of proof of shipment, whichever occurs first, unless they offer to recover the good themselves. The extra cost of a more expensive delivery chosen by the customer is not refunded. Refund uses the same payment method, unless the customer expressly agrees to another method without fees.
Legal exceptions are assessed product by product. They may notably concern goods made according to customer specifications or clearly personalized, as well as certain sealed goods that cannot be returned for genuine hygiene or health protection reasons when unsealed after delivery. A simple opening of packaging is not sufficient to exclude all devices, furniture, or accessories from the right of withdrawal. Applicable exceptions must be announced before purchase.
9. Legal Warranties and After-Sales Service
AmpliDestock remains the customer's contact for warranties for which the seller is legally responsible. A request cannot be dismissed solely because the manufacturer or supplier is abroad or applies a shorter warranty.
The consumer benefits from the legal warranty of conformity and the warranty against hidden defects. To report a defect, they contact the seller with proof of purchase, product reference, and a description of the anomaly. Photographs or a serial number may facilitate identification without creating a formality that would deprive the consumer of their rights.
The consumer has a period of two years from delivery of the good to obtain implementation of the legal warranty of conformity in case of appearance of a conformity defect. During this period, the consumer only needs to establish the existence of the conformity defect and not the date of its appearance.
When the sales contract of the good provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal warranty applies to this digital content or digital service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the conformity defect affecting the digital content or digital service and not the date of its appearance.
The legal warranty of conformity entails an obligation for the professional, if applicable, to provide all necessary updates to maintain the conformity of the good.
The legal warranty of conformity gives the consumer the right to repair or replacement of the good within thirty days following their request, free of charge and without major inconvenience for them.
If the good is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair of the good, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.
The consumer may obtain a price reduction by keeping the good or terminate the contract by being fully refunded against return of the good, if:
1° The professional refuses to repair or replace the good;
2° Repair or replacement of the good occurs after a delay of thirty days;
3° Repair or replacement of the good causes a major inconvenience for the consumer, notably when the consumer permanently bears the costs of recovery or removal of the non-compliant good, or bears the costs of installation of the repaired or replacement good;
4° Non-conformity of the good persists despite the seller's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or contract termination when the conformity defect is so serious that it justifies immediate price reduction or contract termination. The consumer is then not required to request repair or replacement of the good beforehand.
The consumer is not entitled to contract termination if the conformity defect is minor.
Any immobilization period of the good for repair or replacement suspends the warranty that remained to run until delivery of the repaired good.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.
The seller who maliciously obstructs the implementation of the legal warranty of conformity incurs a civil fine of a maximum amount of 300 000 euros, which may be increased up to 10 % of the average annual turnover (article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under articles 1641 to 1649 of the Civil Code, for a period of two years from discovery of the defect. This warranty entitles to a price reduction if the good is kept or a full refund against return of the good.
A commercial warranty is only offered if its content, duration, guarantor, territory, and terms are communicated for the concerned product. No manufacturer or supplier warranty of twelve months valid only in Poland is presented as a limitation of AmpliDestock's legal warranties.
Damages caused by use contrary to instructions, shock, improper maintenance, or unauthorized intervention may not be covered by a warranty, depending on their cause and applicable rules. These situations do not automatically exclude an original defect. A diagnosis or paid out-of-warranty repair requires an estimate or price information and prior customer agreement. No cleaning, transport, or storage fees are imposed without applicable basis and prior information.
10. Special Conditions for Professional Customers
The professional client provides accurate professional information and orders for the needs of their activity. Except for specific legal protection or written agreement, a professional purchase made online does not grant a general right of withdrawal or convenience return. Any possible commercial return is subject to a prior written agreement specifying the accepted condition, transport, and any costs.
Unless expressly agreed otherwise, payment is due in full before shipment. No discount is granted for early payment. In case of professional payment after the agreed deadline, penalties accrue without reminder at the refinancing rate of the European Central Bank applicable plus ten points, without being lower than the legal minimum. The fixed recovery compensation is 40 €, subject to legal exclusions; additional compensation may be requested with proof if the actual costs incurred are higher.
The seller retains ownership of the goods until full payment. For professionals, risks are transferred upon physical delivery to the client or their representative at the agreed delivery location. The client keeps the identifiable goods and takes appropriate conservation measures.
To the extent permitted by law, the seller's contractual liability towards a professional is limited to proven direct and foreseeable damages, up to the amount excluding taxes of the concerned order. Indirect losses of operation, clientele, and profits are excluded to the same extent. These provisions do not apply to fraud, gross negligence, bodily injury, liability for defective products, nor to obligations from which no derogation is permitted; they must not deprive an essential obligation of its substance. They do not constitute a general exclusion of hidden defects.
11. Force majeure, data and intellectual property
Force majeure is assessed according to legal conditions. A stock shortage, supplier difficulty, or transport delay is not automatically a case of force majeure. The prevented party informs the other and takes reasonable measures to limit consequences. The consumer's mandatory rights remain preserved.
Data necessary for ordering, payment, delivery, tracking, and accounting obligations are processed in accordance with the privacy policy. Only providers needing this data for their mission access it within the applicable framework. Subscription to a newsletter remains separate from acceptance of the GTC. The texts, trademarks, and visuals of the site belong to their respective holders; their use remains subject to applicable rights.
12. Complaints, law and jurisdiction
A complaint may be sent to contact@amplidestock.com or to the seller's headquarters. The client retains the right to bring the matter before a competent court.
The GTC are subject to French law. For a consumer residing in another country, this choice does not deprive them of mandatory protections they benefit from when private international law rules make them applicable. Jurisdictions are those competent according to applicable rules, without clause imposing the seller's court on consumers. Translations must faithfully reflect commitments and pre-contractual information; the French version cannot be invoked to reduce mandatory protection or neutralize decisive information provided in the purchase language.
